China Criminal Practice

About

China Criminal Practice (刑事法镜) is an independent legal information and commentary platform focused on Chinese criminal law, procedure and practice. It is not a law firm website and it does not rank, recommend or review lawyers.

Nature of this site

China Criminal Practice (刑事法镜) is founded and maintained by a practicing lawyer. It is an independent legal-information and commentary platform. It is not a judicial, administrative or government body, and it is not the official website of any law firm.

The material here is provided for general legal information and research reference. It is not legal advice for any specific matter and does not create a lawyer-client relationship. Specific cases should be handled through a practicing lawyer’s formal channels.

What this site publishes

  • Stage-by-stage explanations of how a criminal case moves through the mainland Chinese system;
  • Practice notes on cybercrime, white-collar offences and matters involving foreign nationals;
  • Observations on published judgments and publicly reported cases, focused on procedure and evidence;
  • A parallel Chinese edition, so the same subjects are available to both readerships.

Who it is written for

Readers include families of people under investigation, in-house counsel and compliance teams, lawyers and researchers outside mainland China, and foreign nationals who need to understand Chinese criminal procedure. The material is procedural and methodological; it is not advice on any specific case.

Editorial principles

  • Statutory provisions, published cases, practitioner observation and the author’s own analysis are distinguished from one another;
  • Legislation is cited by name and article number, using the version currently in force; material that cannot be verified is not cited;
  • Pending or unpublished matters are not discussed and no party is identified;
  • No success rates, case counts, client lists or testimonials are published;
  • No superlatives such as "best", "top", "leading" or "number one" are used.

Authorship and legal review

Formal legal content on this site is written by its named author. Each article states its author, its legal reviewer and its last updated date.

If the author also carried out the review, the same person is shown. If review is not yet complete, the article is marked "Pending review".

The bilingual edition

The Chinese and English sections are edited separately. A piece written for one readership may be organized differently in the other language, so the two versions are not sentence-for-sentence translations. Where a counterpart exists, the article pages link to each other.

Disclaimer

The information on this website is provided for general informational and educational purposes and does not constitute legal advice for any specific matter. Reading, citing or forwarding this material does not create a lawyer-client relationship and does not give rise to any duty of confidentiality.
